Kahn works to make appealing property taxes more ‘user friendly

LANSING, MI – September 14, 2009 – (RealEstateRama) — With property values across the state and country falling while taxes for some homeowners are increasing, Sen. Roger Kahn introduced four measures in the Michigan Senate to make the appeals process more fair and smooth for property owners.

“These measures will protect Michigan property owners,” Kahn said. “I hope my proposals will help people across the state better understand how to appeal their property tax bills.”

Senate Bill 806 would allow taxpayers to file a protest with a property tax board of review by letter. Another of Kahn’s measures, SB 805, would help ensure that in the case of a property owner securing a lower assessment rate, the lower figure becomes the new baseline for further year assessments.

Kahn also introduced SB 803, which would require the Michigan Department of Treasury to use a sales ratio study based on the calendar year in determining assessments, providing a more timely assessment value.

The Saginaw Township lawmaker has already introduced legislation that requires local governments to send residents an assessment notice 30 days before the first board of review, rather than the current 10 days.

Kahn noted that Gratiot and Saginaw residents attending his property tax forums were upset with the short period they had to prepare their appeals. Kahn also has introduced legislation requiring information regarding the appeal rights of property owners to be more boldly visible on assessment notices.

“Our people had some very valid concerns,” Kahn noted. “We should give them more time to prepare their appeals as well as the ability to appeal by letter. Also, assessment notices should clearly state how residents can appeal, which is required by my Senate approved legislation awaiting action in the House of Representatives.”

Kahn’s bills will be referred to a Senate committee this week.
